Acceptance of Terms
By accessing or using the Montmorency LLP software and services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Services.
Eligibility
You must be:

By using the Services, you represent and warrant that you meet these requirements.
Description of Services
Montmorency LLP provides software that:
- —collects user activity data, including screen recordings, keystroke event data, mouse interactions, and clipboard content;
- —analyzes and processes such data; and
- —uses and commercializes such data, including through licensing and sale.
Explicit User Consent
By using the Services, you acknowledge and agree that the Services collect detailed activity data from your device, including screen content, interaction data, and clipboard information. You further acknowledge that such data may include personal, confidential, or sensitive information. You agree that Montmorency LLP may use, process, and commercially exploit this data as described in the Privacy Policy.
Data Rights and License
By using the Services, you grant Montmorency LLP a worldwide, perpetual, irrevocable, transferable, sublicensable, and royalty-free license to use, store, process, modify, analyze, distribute, sell or license any data collected through the Services.
This license applies to raw data (including recordings and logs), processed and derived data, and aggregated datasets.
This license survives termination of your use of the Services, including after deletion of your account or cessation of use.
Data Deletion and Limitations
Users may request deletion of data under Montmorency LLP’s control. However, data already shared, sold, or licensed to third parties cannot be deleted by Montmorency LLP. Certain data may be retained for legal compliance, business purposes, or archival or research use.
Commercial Use of Data
You acknowledge and agree that Montmorency LLP may commercially use, sell, or license collected data to third parties. This may include artificial intelligence research organizations, commercial partners, and data analytics entities. Data shared may include raw or partially processed data, behavioral and interaction data, and derived insights.
User Responsibilities
You agree to:
- —use the Services responsibly when handling highly sensitive or confidential information, accepting the risks involved,
- —comply with all applicable laws, and
- —not misuse or interfere with the Services.
Sensitive Data Disclaimer
Montmorency LLP applies automated anonymization and masking to minimize the capture of sensitive information. This includes real-time detection of password fields, automatic blocking of sensitive applications (password managers, authenticators, crypto wallets), masking of private messages, and camera detection. While these safeguards are comprehensive, you should exercise caution when handling highly confidential information not covered by automated detection.
Third-Party Data Sharing
You acknowledge that data may be shared with third parties, and that Montmorency LLP does not control how third parties use such data once shared.
Intellectual Property
All rights in the Services, including software and systems, remain the exclusive property of Montmorency LLP.
Termination
We may suspend or terminate access at any time, without prior notice. Upon termination, your right to use the Services ends immediately, and data rights granted to Montmorency LLP remain in effect.
Disclaimer of Warranties
The Services are provided “as is” and “as available.” We make no warranties regarding accuracy, reliability, or fitness for a particular purpose.
Limitation of Liability
To the maximum extent permitted by law, Montmorency LLP shall not be liable for any indirect, incidental, or consequential damages, including data loss, exposure of sensitive information, or business interruption. Total liability, if any, shall not exceed the amount paid by you (if any) for the Services.
Indemnification
You agree to indemnify and hold harmless Montmorency LLP from any claims arising from your use of the Services, your violation of these Terms, or any data collected from your device.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India.
Changes to Terms
We may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
